GENERAL CONDITIONS

These Terms of Use govern the rights and obligations regarding the use of uzoni.rs services. The service is located on the Internet address http://www.uzoni.rs/ (hereinafter: Service). These Terms of Use form an integral part of the Service. It is possible to use the Service to natural and legal persons, solely in the manner and under the conditions described in these Terms of Use, in the manner and under the conditions under which the information society service is provided.

By accessing, using and registering the Service, users agree to the Terms of Use, thus concluding a contract for access to the Service as an information society service provider. For each access to the Content of the Service, these Terms of Use apply.

Business through this Service is regulated primarily by the Law on Electronic Commerce, the Law on Obligations, the Law on Advertising, the Law on Copyright and Related Rights, the Law on Trademarks, the Law on Personal Data Protection, as well as other regulations of the legal system of the Republic of Serbia in parts that are not regulated by the said laws.

The service is dedicated to the preservation and application of the rights to the protection of personal data held by natural persons, as well as copyrights, in accordance with the rules of the information profession, good business practices and in accordance with the applicable regulations of the Republic of Serbia.

The service enables registered users to set up commercial messages and / or use the electronic message system to contact other users of the service. The service does not provide any other services, except for the services provided by the information society. The sole responsibility for the content is that of the person who posted the content or from which the content was downloaded.

The Service has the right, but not the obligation, to remove any content at any time from the Service without the obligation of any prior or subsequent notice or explanation.

SERVICE INTEGRITY

The service is intended for posting messages and ads and for the possibility of using the electronic message system for contact with other users of services. All entries that users leave in any part of the Service must be correct. For the accuracy and correctness of the entered data, only the user who entered the data is responsible for this. Correctness implies grammatical and spelling accuracy. Any use of the Service in its entirety or any part thereof that does not comply with the Terms of Use shall be deemed to be misuse of services and violation of the Terms of Use.

The user chooses the code when registering and is solely responsible for the security of the password and the use of the Service through access data. The user will not use other third party access data or give their user data to a third party. The User may notify the Service if he / she suspects of unauthorized use of his / her access data.

The Service will provide full support for the protection of the rights of personality, privacy, property rights and intellectual property rights at all times to all persons entitled to such rights or to those persons whose rights have been violated on a case by case basis, without delay:

On the reasoned request, supported by the appropriate documentation, remove the contents so that it is not publicly available, and the content is preserved for the needs of proof,
The competent authority, upon request, shall provide information about the user whose entry violates one of the aforementioned or other rights, all in accordance with the regulations of the Republic of Serbia.
The service transmits electronic messages submitted to it by the users of the information society services, but in no way: it does not initiate their transfer, does not select the data or documents that are transmitted, does not exclude or modify the data in the contents of messages or documents, or the selection of the recipient transfer. The Service reserves the right to modify or terminate any element of the Service, the services it provides, and the content or entries that apply to these elements, regardless of who is the author and without prior approval or notice, with the application of good business practices.

All timeframes and deadlines displayed through the Service, as well as the time zone and working days are calculated according to the valid regulations of the Republic of Serbia.

USERS

Users of services accessed through the Service are considered both visitors and registered users.

A visitor is a person who accesses the Service through the Internet within the meaning of these Terms of Use without logging in or registering with the Service. The visitor can get acquainted with the entire content available on the Service, without paying any fee. The registered user is a legal or natural person registered in the Service under the terms and conditions of these Terms of Use. The registered user can post and publish his/her own content and comment.

The user registration itself, as well as all content that the registered user sets up on the Service, does not moderate, modify or in any way materially affect the specified content, and the registered user has exclusive responsibility and bear all legal consequences which from its content on the Service can to come true. The service reserves the right, but it does not have the obligation to perform the lecture in order to maintain the quality of the service, or correct the spelling and grammatical corrections, which in no way affect the content that the user sets through the Service.

The registered user retains all copyright and related rights to the contents of the author. The registered user guarantees that the owner or user of all necessary copyrights is entitled to the entire content, as well as all of its individual parts, which are placed on the Service. For any eventual violation of copyright or related rights, as well as other intellectual property rights, only the registered user who uploaded the content responds.

The registered user can upload different content at the same time. Setting content to the Service does not in any way restrict the registered user to post the same content or publicly announce it elsewhere. The registered user can, without any explanation or notice, at any time, deactivate or modify the content that he has uploaded. The service will deactivate or modify such content at the same time, except for content contained in system-generated backups, and whose contents can not be affected.

By each individual logging in to the Service, the registered user gets access to his account on the Service and the ability to upload content.

By placing content on the Service, the registered user unconditionally and irrevocably authorizes the Service to transfer content to an unspecified number of people, and to remove content without prior or subsequent notice or explanation. The registered user can, at any time, cancel his status as a registered user by submitting a request for deletion of his user account without any explanation or notice.

ASSESSMENT SYSTEM

The registered user has the ability to place a rating. The service retains the discretionary right to cancel the awarded ratings, as well as the right not to annul the rating in each individual situation.

RULES ON PROTECTION OF PERSONAL DATA

The Privacy Policy is an integral part of these Terms of Use. The Service shall process the necessary data of those people who have given consent for processing, for a clearly defined purpose, in a legally permitted manner, so that the person to whom the data relates is not determined or determinable, and after the purpose of the processing is achieved, and in proportion to purpose of processing.

The data processed must be true and complete, as well as to be based on a credible source, or a non-obsolete source. Prior to data collection, the Service informs the person to whom the data relates as follows:

that the person is responsible for collecting the Service data.
That the purpose of data collection and processing is to enable the provision of information society services, the safety of Internet Service users, and the provision of creation and placement of content in accordance with the law.
That the collected data is used in a way that allows the identification of the person who places the ads, in accordance with good business practices, keeping business secrets and law.
That giving personally identifiable information is voluntary, and that no one who wants to be a registered user of the Service is not obliged to leave any information.
That a person who has given consent to the collection and processing of data can withdraw his consent at any time and without reason, which, as a legal consequence, produces a cessation of the possibility of using the Service, and that it ceases to collect any further information from the person whose consent has been withdrawn.
In the event of unauthorized processing of people, they have the right to protection of personal data, as well as other rights that they belong to by law.

The data collected for the above purposes are: Name, surname, e-mail address and IP address of each individual access to the Service. All general acts of the Service must comply with this Ordinance on the protection of personal data. If any general act of the Service does not comply with this Ordinance regarding the protection of personal data, the provisions of this Ordinance shall apply.

NOTICE

The User agrees that the Service may periodically send notices relating to the content of the Service, notices regarding the functioning of the Service, news and actions of the Service itself, as well as advertising notices.

COMPLAINTS

As the Service provides an information society service, it is not possible to declare a complaint on the performed service. The information society service provided by the Service is fully implemented because the provision of the service started after the explicit prior consent of the user to use the service.

COPYRIGHT

The Service has exclusive copyright and intellectual property rights in the Service, as well as on all the individual elements that make it, such as: text, visual and audio elements, visual identity, data and databases, program code and other service elements, of which he/she is the author.

Unauthorized use of any part of the Service, or the Service as a whole, without explicit prior written permission issued by the Service as the holder of exclusive copyrights, shall be deemed to be a violation of the copyrights of the Service and is subject to the initiation of all proceedings in full legal extent.

The service may also contain elements in which other copyrights, trademarks and other intellectual property rights are held by other persons, such as the content of the Service user, the content of business partners, advertisers, and the like. Other persons are solely responsible for the content on which the holders of these rights hold, regardless of the fact that such content is on the Service.

By placing content on the Service, the user agrees that it becomes visible to every visitor of the Service, under the terms and conditions of these Terms of Use. Further transfer of contents of other persons or part of content with any part of the Service is permitted only with the mandatory explicit prior consent of the Service, with the note that the content is downloaded from the Service, indicating the appropriate link on which the content is to be downloaded. The service is solely responsible for the content on which it has copyright.

Each person individually bears responsibility for content that is made his / her own work, that is, for contents that he has set up and made publicly available through the Service.

GUIDELINES

Registered users undertake to comply with the Guidelines here when creating content. The service is entitled, but not obliged, to remove or not publish the content that any registered user places on the Service without explanation.

The user is responsible for the content set, and especially if that content, according to the discretionary assessment of the Service, includes (but is not limited to):

personal names;
openly offensive content, or content that promotes racism, intolerance, hatred, or physical injuries of any kind, directed at any group or individual;
disturbs, or promotes harassment of another person;
exploits people in a sexual, or violent manner;
contains nausea, excessive violence, or offensive content, or contains a link to adult websites;
searches for personal information from persons under the age of 18;
Publicly disclose information that represents, or creates a risk to the privacy, or security of any person;
contains, or promotes information that you know is inaccurate, or misleading, or promotes unauthorized activities, or whose content is offensive, intimidating, threatening, rude, or defamatory;
contains, or promotes, an unauthorized or unauthorized copy of the protected work of another person;
includes the transmission of spam, circular letters, or mass mail, instant messages, or "spam";
contains restricted access pages, or pages that can be accessed only with the help of a password, or a hidden page, or images (those that are not linked to other pages);
encourages, or promotes criminal activities or activities, or provides instructions for the performance of unauthorized activities, including, but not limited to, creating or purchasing illegal weapons, violating someone's privacy, or finding or creating computer viruses;
search for passwords, or information that personally identifies you for commercial, or unauthorized purposes from other users;
includes a photo, or a video of another person that you published without the consent of that person, or
violates the right to privacy, the right to public disclosure, the right to protection against defamation, copyright, the right to a stamp, rights from the contract, or some other personal rights.

Below are examples, without limitation of any kind, activity that is unauthorized or prohibited on the Service:

crime, or delictation, including child pornography, or eroticism, fraud, distribution of pornographic content, distribution or consumption of drugs, gambling, harassment, retribution, spam, pyramid schemes, Ponzi schemes, virus transmission or other harmful files; rights, patent infringement or theft of business secrets;
advertising to users or offering to buy or sell any products or services through unauthorized or unauthorized use of the Service;
bypass, or alteration, an attempt to circumvent, alter, or encourage, or help other people to bypass, or alter one of the security technologies or software that is part of the Service;
falsifying the TCP / IP header, or any part of the information in the header in any post, or in any other way using the Service to send altered, fraudulent, or misleading information identifying the source;
activities involving the use of viruses, bots, worms, or some other computer codes, files, or programs that interrupt, destroy, or restrict the functioning of the computer software or hardware, or otherwise allow unauthorized use, or access to a computer or a computer network;
intervening into the access of any user, host, or network;
overlapping, or blurring advertising through a banner on the user's profile page, or any page of the Service via HTML / CSS, or in some other way;
including HTML, CSS, or any other encoding on the user profile page, including but not limited to any hidden or otherwise secretly contained codes in the sent content that is not related to the nature of the content sent;
any automatic use of the system, such as but not limited to the use of scripts for sending images or videos;
intermingling, interrupting, or creating unnecessary load on the Service, or online, or services related to the Service;
imitation, or attempt of imitation of a legal or natural person;
using the access data or user name of another user at any time, or giving a password to third parties, or allowing third parties to access a non-user account;
selling, or transferring a user profile in some other way;
the use of information obtained from the Service to harass, abuse, or hurt a person, and attempt to do so;
an unauthorized commercial ad on a user profile, or accepting a payment, or anything that has value from third parties in exchange for carrying out commercial activities through unauthorized or unauthorized use of the Service on behalf of that person, or
deletion, or other modification of the notice of copyright, trademarks, or other proprietary rights that appear on the User Content, unless the content is posted by the User;
using meta tags, or other hidden text, or metadata using the Service Name, Trademark, URL, or Product Name without prior express permission of the Service;
an attempt to examine, scan, or test the vulnerability of any part of the Service, or violate any security measures, or identity verification measures;
collecting, or storing personal data about other users without their explicit permission;
imitation, or false representation of a relationship with a person, through a forwarded text, or other form of social engineering, or other forms of fraud;
the use of the Service in a manner inconsistent with any applicable laws and regulations, or the breach of the Service or network security.

The Service has the right, but not the obligation to monitor all user activities, and user content that is connected to the Service. The Service may investigate any reported violations of its Guidelines and other applications, and may take any legal, or technical action that it considers appropriate. The service will investigate the circumstances that may involve these violations and may call for cooperation and cooperate with the competent state authorities during the identification, investigation or prosecution of persons involved in the violation of the Guidelines or violation of the law. The Service reserves the discretion to use all remedies, including but not limited to the removal of the User Account and User Content, and to immediately suspend all the Services of the Service that the User uses, in case of any violation of these Terms, or in the event that the Service is not can verify, or verify any information that the user sends the Service.

ADVERTISING

The advertiser is the Service that provides the information society service and provides the service of advertising solely on the Internet. A person advertised through the Service is not obliged to submit an Advertising Declaration in accordance with Article 45 of the Law on Advertising, in conjunction with Article 19, but is obligated to clearly identify it in order to use the advertising service.

For the content, accuracy and correctness, as well as the validity or admissibility of the advertising message, the sole responsibility lies with the person who entered the advertising message. For all legal consequences arising from the entry of an advertisement, only the person who is advertising the message to the Service is responsible. The service reserves the right, but it does not have the obligation to perform the lecture in order to maintain the quality of the service, or correct the spelling and grammatical corrections, which in no way affect the content that the user through the Service sets.

The Service reserves the right not to publish content that violates the provisions of the Law of the Republic of Serbia, and in particular the Law on Advertising. In case of receiving such an ad, the Service will contact the advertiser to edit the advertisement. The Service may at any time, at its sole discretion, refuse to post any advertising message violating the provisions of the Law or these Terms of Use, but is not responsible for the content of such a message, but only for the person being advertised or provided by such content .

REGISTERED USERS- PHYSICAL PERSON

Registration to the Service for Individuals is free of charge and available to all visitors. When registering, a physical person needs to fill out a personal data form. These data are used in the manner prescribed by the Personal Data Protection Policy.

POSITION OF ADVERTISING MESSAGES - ADVERTISING

Registered users who advertise an ad are submitted through the order form on the Service. According to Article 45 of the Law on Advertising, there is no obligation to submit a Advertising Declaration for advertising on the Internet. If all the required fields from the order form are filled in correctly and if the ad is complete, it is posted on the Service afterwards.

LIMITATION OF LIABILITY

Users use the Service solely on their own responsibility. The User explicitly accepts that the Service can not be held responsible for the behavior of other users or third parties, and that the risk of possible damage is entirely borne by those persons, in accordance with the applicable legislation of the Republic of Serbia.

The texts (comments), ratings, and other content that users place in the intended sections are to be accurate and correct. For the accuracy of the data entered, the users who entered them are the ones that match them. The accuracy of the input implies that they come from some competent source, or the personal experience of the user. For each individual input, the user who made the entry has the sole responsibility.

The service does not guarantee the accuracy, reliability, nor the content set by the user. The service does not initiate the transmission of an electronic message handed over by the user of the service, does not select the data or documents that are being transmitted, does not exclude or substantially change the data in the contents of the message or document and does not select the recipient of the transfer. The service reserves the right, but it does not have the obligation to perform the lecture in order to maintain the quality of the service, ie correct the spelling and grammatical corrections, which in no way affect the data and integrity of the data that the user through the Service sets.

This liability provision applies to all damages (material and / or intangible) or injuries that might arise from hidden deficiencies, errors, interruptions, deletions, malfunctions, delays or the transfer of computer viruses, interruption in communications, theft, destruction or unauthorized access to data, alteration or misuse of data by third parties, termination of the contract, conduct contrary to the Terms of Use, negligence, etc.

Except in the case of intent or gross negligence, the Service is not responsible for any possible temporary unavailability of the Service, nor for partial or complete failure or misapplication of the Service. The service is not responsible for technical problems that may lead to delays and / or erroneous processing of electronic data, including system clock. For the foregoing, ISPs are responsible.

As an information society service provider, the Service is not responsible for any content posted by another person, including, but not limited to, an advertisement that is being transmitted because it neither initiates the transfer nor does it select the content that is being transferred, nor has it excluded or changed data in the content being transmitted, nor is it selected by the recipient of the transfer or the content recipient.

The service does not guarantee the behavior of third parties, nor of its users. The Service, among other things, does not provide any guarantee that the Advertised User will be contacted by third parties (or that he will conclude the legal job that is the subject of the advertisement), or that the information available will contain accurate and true information.

The service may be temporarily unavailable or available on a limited scale, as a result of regular or extraordinary maintenance of the system, or in case of system upgrades.

JURISDICTION AND SETTLEMENT OF DISPUTES

Anything not regulated by these Terms of Use shall be subject to the applicable regulations of the Republic of Serbia.

Applicable laws of the Republic of Serbia shall apply to all disputes that may arise between the Service and the users regarding the use of the Service. The service and the user are obliged to try to resolve the dispute peacefully, and if they do not succeed, the dispute resolution authorities are court cases.

All disputes that may arise between two users in connection with the use of the Service shall be subject to the applicable regulations of the Republic of Serbia. Users are obliged to try to resolve the dispute peacefully, and if they fail to do so, the Commercial Court in Belgrade for disputes between legal entities, ie the First Basic Court in Belgrade for disputes between natural persons, or natural and legal persons . The Service shall in no way intervene or participate in any dispute that may arise between the user of the Service, unless it is bound by law as a necessary rival.

FINAL REGULATIONS

The Service is entitled to modify or supplement these Terms of Use at any time by publishing the amended text in the consolidated text on the Internet.

If the already registered user does not express an answer in the specified deadline (by clicking on the link for accepting the Terms of Use), he/she will be deemed to comply with the new Terms of Use. If the already registered user explicitly (by clicking on the link for non-acceptance of the Terms of Use) does not accept these Terms of Use, his status will be deemed to have ceased his / her status, to discharge all previous rights and obligations, and the contractual relationship is terminated under the previous Terms of Use. By entering new user terms into force, the acquired user rights are not affected. These Terms of Use shall apply for eight days from the date of their publication on the Website of the Service.

Each printed copy of these User Terms produces a lot of legal effect based on the provisions of the Electronic Document Act, and it can not be challenged by its validity or probative value.
